Articles of Incorporation: The Articles of Restatement for Cades Cove Homeowners’ Association, Inc. for the Cades Cove Homeowners’ Association, Inc., outline the governance of the corporation and the corporation’s status in the State of North Carolina. The articles include the name of the corporation, the type of corporate structure (e.g. nonprofit corporation) the Registered Agent, the number of authorized shares, the effective date, the duration (perpetual by default), and the names and signatures of the incorporators. The restated articles were updated and approved by the Members on 04/20/2017.
Cades Cove Covenants: The Declaration Covenants, Conditions and Restrictions (CC&Rs) is the legal document that lays out the guidelines for Cades Cove. The CC&Rs are recorded in with Brunswick County and are legally binding. They specify how the homeowners are to participate as members, officers, and committee members of the Cades Cove Homeowners’ Association. Updated as needed.
Cades Cove Rules and Regulations: In addition to the CC&Rs, reasonable Rules & Regulations that supplement and are not in conflict with the CC&Rs may be promulgated and amended from time to time by the Board of Directors per the Bylaws.
Cades Cove Bylaws: The Bylaws of the Cades Cove Homeowners’ Association, Inc., are the rules established by the community to regulate itself, as allowed or provided for by the State of North Carolina. The Bylaws spell out how the corporation/neighborhood shall be governed and form the Homeowners Association and the Board of Directors. Bylaws were updated and approved by the Members at 12/06/2018 annual meeting.
Cades Cove Design Guidelines: The Design Guidelines for Cades Cove are guidelines put in place in order to maintain the architectural standards of the neighborhood. They are designed to safeguard the members of the Cades Cove Homeowners’ Association, Inc. from the consequences of unauthorized changes or modifications to a lot or residence with the objective of preserving the aesthetic appeal of the neighborhood. Last updated in August of 2019.
